Rules of Auctioning

BidWhack will notify you by either email or text message to tell you the status of your bids. If you wish to stop receiving these notifications text STOP to 87878 (if you've bid via text messaging). When you are unsubscribed you will not receive any further communication from BidWhack, unless at the end of an auction you are the winner.

Terms and Conditions

By participating in a bid on this site, you the user agree to these terms and conditions.

BidWhack is entitled to change these terms and conditions at its discretion. The new terms and conditions will govern all BidWhack Auctions that commence after the time they are published on the site.

Participation in auctions held on this site is only open to persons aged 16 years and over.

BidWhack reserves the right to extend the closing date of an auction should a minimum number of bids for that auction not be made by the closing date. BidWhack reserves the right to extend the closing date of an auction should no lowest unique bid exist for that auction by the closing date.

All Bids are deemed to be received at the time of receipt into the BidWhack database, not at the time of transmission by the bidder. If bids are received after the closing date of the auction they are considered void.

BidWhack reserves the right to cancel any Bid without making a refund of the applicable processing charges if the bidder violates this agreement in any way.

The delivery of the product and/or the service to the Successful Bidder is subject to payment in full of the Lowest Unique Bid by the Successful Bidder.

All products and services on this site and in this database are provided without any warranty, express or implied, as to their completeness, merchantability, function, operation etcetera. Your participation in any way in a BidWhack auction is governed by the laws in your local jurisdiction. BidWhack makes no representation as to the legality of BidWhack bids in your jurisdiction. If any portion of this disclaimer is deemed to be un-enforcable, it shall not affect or compromise the enforcibility of any other portion or portions of this Disclaimer. Please use at your own risk.

All products sold through BidWhack Inc. are FOB Toronto Ontario Canada. All shipping and delivery charges are the responsibility of the user. Products will be available for delivery 4-6 weeks after the close of an auction.

The materials at this site are provided "as is" without any express or implied representations or warranty of any kind including representations or warranties of merchantability, non-infringment of intellectual property, or fitness for any particular purpose. In no event shall BidWhack, or its agents or officers or assigns be liable for any damages whatsoever (including without limitation, damages for loss of profits, business interruption, loss of information) arising out of the use of or inability to use the materials, even if BidWhack has been advised of the possibility of such damages. Because this product is delivered electronically there is no provision for refunds after credits and or products have been purchased and or used.

BidWhack shall not be liable for any failure to perform its obligations under this agreement caused by matters beyond its reasonable control.

BidWhack shall not be liable to any Bidder or Successful Bidder for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this agreement or otherwise).

Without limiting the preceding clause, the liability of BidWhack under this agreement (whether arising in negligence or otherwise) will not under any circumstances exceed the greater of
(a) $50, or
(b) an amount equal to the sums paid or payable by or to you in the BidWhack Auction to which such liability relates, regardless of the cause or form of action.

License Agreement

By purchasing access to bid credits on this site, you agree that the bids may only be used for your personal use and may not be sold or redistributed without the written consent of BidWhack. No license or claim, whether express or implied, is made or deemed to be entered into between the user and Bid Whack Inc. with the exception that auctions will be conducted as described and prizes delivered as promised to winners FOB Toronto Ontario.
